STATEMENT: PA Budget and Policy Center on Gov. Wolf's Veto of Fiscal Code (HB1327)

Marc Stier, Director of the Pennsylvania Budget and Policy Center, made the following statement on Governor Wolf's veto of the fiscal code (HB1327) tied to HB1801:

"PBPC supports Governor Wolf’s decision to veto HB1327, the Fiscal Code bill amended by the Senate Rules and Executive Nominations Committee in conjunction with the passage of HB1801.

"As amended, HB1327 would undermine regulations that are critical to public health and the environment and would likely be ruled unconstitutional. 

"HB1327 includes provisions that undermine the process by which the Environmental Quality Board has been developing new regulations on oil and gas drilling. These regulations are critical to protecting out water and air. It also purposefully obstructs the process for creating a state plan to implement the Clean Power Plan. 

"Finally, HB1327 is not only bad policy but is unconstitutional. Article III, Section 3 of the State Constitution limits the subject matter of statutes implementing Pennsylvania’s budget to spending matters only. The provision in HB132 that interfere with the regulatory process and the Clean Power Plan cannot under our Constitution, be included in the fiscal code."
